# Terms of Service — Conventional Art

These Terms of Service ("Terms") govern your use of https://conventionalart.com (the "Site") and the products we sell through it. They also describe the operation of the Broadcast Layer, an internal application Conventional Art uses to publish content about our own artworks to our own social media accounts.

"Conventional Art", "we", "us", and "our" refer to Conventional Art LLC.

By using the Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site.

## 1. The service

Conventional Art is a fine-art print brand. We design original artworks, generate them with the assistance of AI tools, and produce them as limited-edition prints in canvas, framed, acrylic, and rolled-paper formats, shipped worldwide on a made-to-order basis.

The Broadcast Layer is a separate, internal-only application operated by Conventional Art. It generates and publishes promotional posts about our own artworks to our own social media accounts via official platform APIs. It is not offered as a service to third parties, and members of the public cannot sign in to it.

## 2. Eligibility

You must be at least the age of majority in your jurisdiction (typically 18) to make a purchase on the Site. By placing an order you represent that you meet this requirement.

## 3. Orders, pricing, and payment

- Prices on the Site are in the currency displayed and may change at any time before you complete an order.
- We reserve the right to refuse or cancel any order, including for reasons of pricing error, suspected fraud, or unavailability.
- Payment is processed by our payment processors. You authorize the relevant charge when you submit your order.
- Free worldwide shipping is included in the displayed price unless otherwise stated on the product page.

## 4. Production, shipping, and delivery

Each print is made to order. We aim to dispatch within 3–5 business days of order confirmation. Standard delivery windows after dispatch:

- United States, Canada, European Union, United Kingdom: 5–14 business days.
- Australia, New Zealand: 7–16 business days.
- Rest of world: 7–21 business days.

These windows are estimates. Customs, weather, and carrier delays can extend them. We are not responsible for delays caused by carriers or customs.

## 5. Returns, refunds, and damage

Because every print is made to order, we do not accept returns for change of mind.

If your order arrives damaged or with a manufacturing defect, contact us within 14 days of delivery with photographs of the damage and the original packaging. We will replace the affected item at no cost or, at our discretion, issue a refund.

## 6. Intellectual property

All artwork, written content, and design on the Site are the intellectual property of Conventional Art or its licensors. Purchase of a print grants you the right to display the print in your own personal or professional space. It does not transfer copyright, and it does not grant you the right to reproduce, redistribute, resell, or create derivative works from the artwork.

Trademarks, logos, and the "Conventional Art" name are the property of Conventional Art.

## 7. Acceptable use

When using the Site you agree not to:

- Use the Site for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the Site, our servers, or any related infrastructure.
- Interfere with the normal operation of the Site, including through automated scraping, denial-of-service attempts, or any form of probing or testing without our express written permission.
- Reproduce or republish artworks, images, or written content from the Site without permission.

## 8. Third-party services

The Site relies on third-party providers including Shopify, Stripe, Klaviyo, and shipping carriers. Their terms of service and privacy policies also apply where they process information for us.

The Broadcast Layer uses the official APIs of Anthropic and the social media platforms named in our Privacy Policy. We operate within the terms of service of each of those providers.

## 9. Broadcast Layer — first-party use

The Broadcast Layer is operated by Conventional Art for our own use only. It is not a service offered to members of the public. No login, sign-up, or account creation is available to third parties.

When we authorize the Broadcast Layer to access our own social media accounts, we do so using official OAuth flows and App Passwords provided by each platform. We may revoke that access at any time.

The Broadcast Layer publishes content authored by Conventional Art and reviewed by the Conventional Art operator. It does not auto-publish without operator approval in its current version.

## 10. Disclaimer of warranties

The Site and the products are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Statutory consumer rights that cannot be excluded under the laws of your jurisdiction are not affected by this disclaimer.

## 11. Limitation of liability

To the maximum extent permitted by law, the total liability of Conventional Art arising out of or relating to these Terms or your use of the Site will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded by applicable law.

## 12. Indemnification

You agree to indemnify and hold Conventional Art harmless from any claim arising from your breach of these Terms or your misuse of the Site or its content.

## 13. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have breached these Terms. You may stop using the Site at any time.

## 14. Governing law and disputes

These Terms are governed by the laws of Canada, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

If you reside in a jurisdiction with mandatory consumer protections, those protections apply notwithstanding this clause.

## 15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top. Material changes will be announced on the Site at least 14 days before they take effect, where required by law. Your continued use of the Site after the effective date of the updated Terms constitutes your acceptance of the new Terms.
